El Tribunal Supremo, que en el pasado mes de octubre estimó varios recursos y exigió el cumplimiento de condena a Aena por la contaminación acústica en la urbanización madrileña considerando lesionado el derecho de los recurrentes "apreciando una situación de contaminación acústica en la Ciudad Santo Domingo contraria al derecho fundamental reconocido por el artículo 18.1 de la Constitución" ("Se garantiza el derecho a la intimidad personal"), en una sentencia hecha pública esta semana no considera que el ruido por el sobrevuelo de aviones que aterrizan o despegan del aeropuerto madrileño lesione su derecho fundamental a la vida y a la integridad física que consagra el artículo 15 de la Carta Magna.
